These Terms of Service ("Terms") govern your access to and use of the Oxyye website and gym-management platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a gym or business, you represent that you are authorised to bind that organisation.
1. Your account
- You must provide accurate information and keep your login credentials secure.
- You are responsible for all activity that happens under your account.
- Accounts are provisioned by invitation; you may not share access or resell the Service without our written consent.
2. Acceptable use
When using the Service, you agree not to:
- Break any law or infringe anyone's rights.
- Upload data you don't have the right to store or process.
- Attempt to gain unauthorised access, probe, or disrupt the Service.
- Reverse-engineer, scrape, or misuse the platform or its APIs.
3. Your data, and how we process it for you
You own the gym and member data you put into Oxyye. You grant us a limited licence to host and process that data solely to provide the Service. This section is the data-processing agreement between you and Oxyye under India's Digital Personal Data Protection Act, 2023 (the "DPDP Act").
- Roles. For your members' data you are the data fiduciary and Oxyye is your data processor. We process member data only on your documented instructions, which are the features you use in the Service, and never for our own purposes.
- Your duties as fiduciary. You must have a lawful basis, usually consent, to collect and keep each member's data; give members a clear notice of why you collect it; obtain verifiable parental consent for members under 18; keep the data accurate; and answer members' requests to access, correct or erase their data. Oxyye gives you tools for this: the join form carries a consent line, and member records can be exported, corrected and deleted from the dashboard.
- Messages to members. WhatsApp reminders, AI calls and broadcasts go out in your name. You are responsible for having members' consent to be contacted, and for following TRAI's rules on commercial communication. Transactional messages such as receipts and renewal reminders need no separate marketing consent; promotional broadcasts do.
- Our duties as processor. We keep member data confidential, protect it with the safeguards on our Security page, use only the sub-processors listed in our Privacy Policy (and tell you before adding one), help you respond to member requests within your legal deadlines, notify you without undue delay of any personal data breach affecting your members, and delete or return member data within 90 days of your account closing, except what we must keep by law.
- Where data lives. Our providers host data in India, Singapore and the United States, as the DPDP Act permits. If the law comes to require Indian-only storage we will move without charge to you.
- Sensitive data. Do not store caste, religion, medical diagnoses or biometric data in Oxyye. Fitness goals and body measurements a member gives their trainer are fine; treat them as the member's and delete them when the member asks.

4. Fees & billing
- Paid plans are billed in advance on a recurring basis at the price shown when you subscribe.
- Payments are processed by our payment partner; by subscribing you also agree to their terms.
- Unless stated otherwise, fees are non-refundable except where required by law.
- We may change pricing with reasonable prior notice; changes apply to the next billing cycle.
5. Trials & early-partner terms
We may offer free trials or early-partner pricing. Those offers are provided as-is and may be changed or withdrawn. Any special pricing continues only for as long as we state at the time of the offer.
6. Availability
We work hard to keep Oxyye available and reliable, but the Service is provided on an "as available" basis. We may perform maintenance, update features, or suspend access where necessary to protect the Service or comply with the law.
7. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to Oxyye or others. On termination, you may request an export of your data within a reasonable window before it is deleted.
8. Disclaimers & liability
To the maximum extent permitted by law, Oxyye is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the fees you paid us in the three months before the claim arose.
9. Governing law
These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts at our registered place of business.
10. Changes
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
